Terms of Use

The following terms regulate the use of the website www.oshkaonline.com (hereinafter referred to as "Terms of Use" and "the Webite") and all the services and/or products offered on the website. These terms apply to any use of the website, including the purchase of jewelry and/or other products and services offered on the website. The website operator may change the terms of use from time to time, and any use of the site expresses agreement to the updated terms of use as published on the website.

 

The Website  

The website is used for purchasing jewelry from the site operator. All images on the site are for illustration purposes only. Since jewelry may appear different due to the manner or conditions of photography, the purchaser waives any claim in this regard, except for the right to return the jewelry as detailed in the cancellations and refunds section in the terms of use below. The price displayed next to the jewelry is the total price, plus shipping fees detailed on the order completion page.

The prices of the jewelry displayed on the website are valid only at the time of the transaction. The website operator reserves the right to update prices and/or jewelry on the website at any time, and these changes will take effect from the date of their publication on the website, without affecting the validity of orders that have already been placed and paid for. The website operator may offer jewelry at promotional prices from time to time; promotional prices will apply only during the promotion period.

The delivery of the jewelry depends on the stock available with the website operator at the time of order fulfilment. If the jewelry is not in stock, the website operator will make an effort to order and supply the jewelry. The website operator reserves the right to inform the buyer of the cancellation of the order due to stock or delivery issues.

 

Ordering Process

Making purchases through the website is conditional on providing details such as name, address, valid email address, and valid credit card details. In the case of orders requiring registration on the website, the user will be asked to choose a username and password (hereinafter: "the registration process"). It is clarified that the user must provide accurate, truthful, and complete information. Providing fictitious and/or incorrect information may prevent the ability to make purchases on the website. The website operator may establish, from time to time, additional or alternative identification methods.

The buyer should use the credit card details in their possession only, or the credit card details for which the cardholder has expressly given permission for the buyer to use. The website operator does not retain the credit card details of the buyer. The use of a credit card is expected to exploit part of the buyer's credit framework. The invoice will be sent to the buyer along with the jewelry, or electronically to the details provided by the buyer.

The jewelry is delivered by a courier company. The buyer must be available to coordinate and be present at the address provided at the agreed-upon time to verify their identity and receive the jewelry. Self-pickup is possible only with the approval and coordination with the website operator, at her discretion.

The website operator reserves the right to cancel or block the use of the website, including order cancellation, in any of the following cases (without prejudice): the user violates their terms of use; during registration for the service, the user provides incorrect details; the user engages in an act or omission that harms or may harm the website operator or third parties; if the payment method entered by the user is blocked and/or restricted for use, etc.; if the user has a financial debt to the website operator, and this debt has not been settled despite the expiration of the deadline for its execution; if there are issues with collecting the cost of the jewelry, communication issues, force majeure, etc.

The website operator may limit the quantity or type of products in each order.

 

Warranty for Jewelry

The website operator provides a one-year warranty for the jewelry from the date of purchase. In the case of a defect in the jewelry determined, at the discretion of the website operator, to have occurred as a result of reasonable use, the jewelry will be repaired, or a credit will be given to the website, which can be redeemed within one year from the date of issuance, all at the discretion of the website operator.

It is clarified that the warranty for jewelry does not cover damage caused by unreasonable use (such as impact, use of tools, contact with chemicals, temperature damage, water damage, etc.). The warranty does not include shipping fees, taxes, and other charges.

The condition for activating the warranty is the submission of the defective jewelry in its original packaging (along with documents and certificates, if provided).

 

Shipping

The detailed shipping terms below are provided by the Israel Post Company. They are the responsibility of the courier company and are subject to changes from time to time due to the courier company's operations.

Shipping fees and additional charges, such as insurance fees for damage and loss, are specified on the item order page and in our shipping policy.

Generally, standard shipping times are 10 to 21 business days after the order has been placed. Express shipping times are 5 to 7 business days. During holiday periods or online sales events, delays in distribution times may occur. 

The Israel Post Company hereby wishes to clarify that there are reasons beyond its control that may cause delays in the delivery of mail abroad, including (but not limited to): security situation, flight availability (including flight delay/cancellation), lack of space on the flight, delays in the destination country, weather air and force majeure. 

Intellectual Property Rights

All copyrights and intellectual property rights inherent on the website and any part thereof belong to the website operator and/or a third party that has granted permission to use the intellectual property for the sole purpose of the website. The website name, the operator's name, and trademarks (both registered and unregistered) are the exclusive property of the website operator.

The website operator is not responsible for the design of the jewelry when acting as a distributor.

The website is intended for personal, private, or family use only, and any commercial or business use is strictly prohibited. Copying, distributing, making changes, broadcasting, publicly displaying, duplicating, publishing, licensing, creating derivative works from the website or any part thereof is not allowed without the explicit written consent of the website operator.

 

Usage Restriction

The use of the website is allowed only if the user (a) provides true and accurate information; (b) is 18 years old or older or has received parental and/or guardian approval to use the website; and (d) the user's use of the website does not violate any law, regulation, or other commitment.

 

Website Responsibility

The website is provided "as is." The website operator does not guarantee that the website's services will not be disrupted, will be provided in an orderly manner or without interruptions, and will be immune from unauthorized access or damage, disruptions, malfunctions, or failures – all of which may occur in hardware, software, communication lines, and systems, whether owned by the site operator or its providers. Under no circumstances will the site operator be liable for any type of damage arising or related to the use of the website.

The website operator shall not be responsible for any damage that may be caused to the user, including delays in the supply of products, as a result of events that are beyond the control of the website operator.

 

Advertisements and Links

The website may contain links to external websites that are not operated by the website operator, and will not be responsible for the content, services, or products appearing on them.

 

Responsibility for Advertising Content

The responsibility for the content of advertising, when published from time to time by third parties on the website, lies solely with the advertisers. The operator or anyone acting on its behalf has no responsibility for the content of the advertisements on the website or their reliability.

 

Privacy Policy

The user hereby consents to the monitoring of their use of the services by the website operators (including through "cookies" and similar means) and the use of any information for control, monitoring, development, or maintenance of service quality, their level, and proper functioning and/or for compliance with any law.

In the event of a breach of any terms of use or legal provisions by the user, the website operator may, at its discretion, provide the user's details to a third party, including an investigative body requesting the information.

The website operator will receive and/or disclose information about the user if provided by the user during registration or use of the website; if the user registers through a social network such as Facebook; user data such as IP, search history leading to website navigation, and so on.

 

Mailing and Advertisements

The user hereby consents to receive communications and advertisements for the details provided to the site operator during registration for newsletters or making a purchase.

The user may inform the website operator at any time of their refusal to receive advertisements, regularly in relation to the advertisement, or to the email address listed at the end of the terms of use, at the user's choice.

 

General

These terms of use are governed solely by the laws of the State of Israel. It is agreed that in any dispute arising from the use of the website and/or the application, the exclusive jurisdiction of the courts in the Tel Aviv district shall apply, and that shall be the exclusive place of jurisdiction.

If a court (including a court or tribunal) determines ("legal assessment") that a provision of these terms is invalid and/or unenforceable, it will not invalidate the remaining provisions of these terms, and/or the invalidated and/or diminished part of that provision, as determined by the legal assessment.
